General conditions of sale
ARTICLE 1 – GENERAL:
Products of the Terres Olive brand are the property of MM&Partners, a company with a share capital of 1000 euros, whose registered office is located at 565 chemin de la Crau 13670 Saint-Andiol, registered with the R.C.S of Tarascon under SIRET N° 94908865200035 – VAT N° FR39949088652 – APE 4791B, hereinafter referred to as "MM&Partners". These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply exclusively to all sales of products or services by MM&Partners to any individual or legal entity acting for the satisfaction of their personal needs or acting in the context of their professional or commercial activity (hereinafter referred to as "Client"). All other conditions are binding on MM&Partners only after written confirmation from them. Any other document than these GTC, including catalogs, advertisements, price lists, handwritten notes, has only an informative and indicative, non-contractual value and can, as such, be modified by MM&Partners without prior notice. At the time of placing an order, the client acknowledges having read and unreservedly accepts these general terms and conditions of sale.
ARTICLE 2 – PRICES:
The prices of our products are indicated on the website in euros, including all taxes (TTC), excluding processing and shipping costs. MM&Partners reserves the right to change its prices at any time. For an order, products will be billed based on the rates in effect at the time the order is confirmed. Products remain the property of MM&Partners until full payment of the price.
ARTICLE 3 – PROCESSING AND SHIPPING FEES:
Products are delivered to the shipping address indicated during the order process. Deliveries in France are made by a suitable carrier.

ARTICLE 5 – ORDER VALIDATION:
Client Validation
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Validation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale. For orders placed directly on our website or by telephone, if you have provided us with an email address, you will receive an order confirmation email.
Unless proven otherwise, the data recorded by MM&Partners constitutes proof of all transactions between MM&Partners and its clients.
Validation by MM&Partners
Upon receipt of orders, MM&Partners ensures the consistency of the data provided. As part of its policy to combat fraudulent payments, MM&Partners reserves the right to conduct any necessary investigation before validating an order. This may include, in particular, requesting proof of address or requesting your bank's contact details. When such a procedure is initiated, the order validation is suspended. If the order is not validated within 14 days, the order will be cancelled and the amounts paid refunded. This period may be extended if document exchanges are ongoing between the client and MM&Partners.
ARTICLE 6 – AVAILABILITY:
Our product offers are valid as long as they are visible on the website, within the limits of available stock. In the event of product unavailability after your order (stock error, product breakage), we will inform you by email or telephone. We will then offer you a refund for the missing product(s) by credit card within a maximum of 14 working days from the client's decision by bank transfer.
ARTICLE 7 – DELIVERY:
Products are delivered to the delivery address you indicated during the order process. Deliveries are made by a suitable carrier selected by MM&Partners.
For credit card payments, orders are shipped within 5 days of online validation.
ARTICLE 8 – DELIVERY TIMES:
The delivery times indicated here are valid under normal service conditions and for shipments made by our usual carriers.
If the processing of your order (especially due to the weight of the packages) requires a specific routing solution, the delivery times will be specified to you when you place your order. If these deadlines are not satisfactory to you, you will have the option to cancel your order. Similarly, in the event of a strike by road carriers (more generally, any social disruption), or climatic incidents, delivery times may be extended. These deadlines apply to deliveries in Metropolitan France, for working days, excluding postal delivery problems and subject to product availability.
ARTICLE 9 – DELIVERY DEADLINES:
The deadlines indicated in Article 8 are the usual delivery times. We undertake to deliver orders to France: within a maximum of 15 days following receipt of payment.
ARTICLE 10 – PAYMENT:
Payment for your purchases is made in cash:

either on our website by credit card: Visa, MasterCard, Carte Bleue. Payments are secured by the Stripe solution in conjunction with our bank CIC.
No payment terms are granted and orders are not shipped until payment has been received and cleared.
Discount codes are only applicable to the value of the products, which must be at least equal to the value of the voucher and cannot concern shipping costs. This offer is not cumulative. Discount codes are not retroactive and cannot be applied once the order has been placed. Discount codes offering free products are valid within the limits of available stock. Discount codes are valid until their expiry date.
ARTICLE 11 – COMPLAINTS AND AFTER-SALES SERVICE:
In the event of exercising the right of withdrawal within the aforementioned period, we ask you to contact: contact@terresolive.com . We will refund the product(s) concerned within a maximum of 14 days from the date of the return request. Shipping and return costs are the responsibility of the buyer. The return method is at the customer's choice. Returns must be in their original and complete condition (packaging, accessories, instructions, etc.). Return address: Terres Olive – 565 chemin de la Crau 13670 Saint-Andiol. We cannot accept returns of products that have been opened or whose packaging has been damaged. No return or replacement of any product will be accepted after the expiry date. If these products are nevertheless returned, they will not be subject to any refund whatsoever.
Packages delivered late
In case of non-compliance with delivery times, the client has the option to terminate the contract and may request a refund for the ordered products as well as shipping costs. MM&Partners will inform the client of any delay as soon as possible.
Package return
In the event of a package return, the address provided by the customer was incorrect or the package was held. The carrier will return the package to us. We will notify you as soon as possible. A second shipment can be made upon payment by the customer of a fixed shipping fee of 20 euros. If the customer prefers to cancel their order, it will be refunded, excluding shipping costs.
Lost / undelivered packages
In the event of a lost package (the carrier misplaced the package during transit and the customer was never delivered), MM&Partners undertakes to ship a second package at its own expense if the original package cannot be found.
Defective or damaged products
MM&Partners will carry out all necessary checks and, if necessary, ask the customer for any relevant information or photos. Following this, MM&Partners may respond favorably or unfavorably to the customer's requests. If the response is favorable, we undertake to refund or exchange apparently defective, damaged or spoiled products (re-shipment is at MM&Partners' expense).
In this case, please contact us at contact@terresolive.com to describe the problem encountered in detail. No return or replacement of any product will be accepted after a period of 5 working days following the date of receipt of your complaint.
Order preparation errors
For any order preparation errors, please contact us at contact@terresolive.com to describe the problem encountered in detail.
MM&Partners will carry out all necessary checks and, if necessary, ask the customer for any relevant information or photos. Following this, MM&Partners may respond favorably or unfavorably to the customer's requests. If the response is favorable: if applicable, MM&Partners will request the return of products shipped in error at its own expense.
ARTICLE 12 – REFUND:
Refunds for products in the cases referred to in Article 10 will be made as soon as possible and no later than 14 days following the date on which the right was exercised.
ARTICLE 13 – APPLICABLE LAW – DISPUTES:
This contract is subject to French law. The language of this contract is French. In the event of a dispute, only French courts will have jurisdiction.

You have a right of access and rectification for all data concerning you in accordance with the right defined by the Commission Nationale Informatique et Liberté (CNIL). Any simple or hypertext link is strictly prohibited without written agreement from MM&Partners.
ARTICLE 17 – CONSUMER MEDIATOR:
Since January 1, 2016, all consumers have the right to free access to a consumer mediator for the amicable resolution of a dispute with a professional.

The request must include the last name, first name, postal address, email, and if possible, the client reference; and must be accompanied by proof of identity.
MM&Partners will respond within 1 month after the right has been exercised. In certain cases, due to the complexity of the request or the number of requests, this period may be extended by 2 months.
These rights may, in certain cases provided for by the regulations, be subject to exceptions.

What are the rules regarding commercial prospecting?
MM&Partners uses your contact details to send you targeted advertisements, particularly by email, postal mail, on social networks, or third-party websites.
MM&Partners complies with the rules set out in Directive 2002/58/EC of July 12, 2002, which requires prior express consent from the client for sending commercial prospecting by electronic means (email or SMS). Thus, when placing an order on the site, you are asked for your consent to receive the MM&Partners newsletter by email.
MM&Partners will not send you personalized solicitations by email or SMS if you have not consented.
