General conditions of sale
ARTICLE 1 – GENERAL:
The products of the Terres Olive brand are the property of the company MM&Partners, with a share capital of 1000 euros, whose head office is located at 10 rue Eugène Labiche 75116 Paris, registered with the RCS of Paris under SIRET number 53252444400033 – VAT number FR 39949088652 – APE 4791B hereinafter “MM&Partners”. These General Terms and Conditions of Sale (hereinafter “GTC”) apply exclusively to all sales by MM&Partners of products or services made to any natural or legal person acting for the satisfaction of their personal needs or acting within the framework of their professional or commercial activity (hereinafter “Customer”). All other conditions are binding on MM&Partners only after written confirmation from it. Any document other than these General Terms and Conditions, including catalogues, advertisements, price lists and handwritten notes, has only an informative and indicative value, is not contractual and may, as such, be modified by MM&Partners without notice. At the time of placing an order, the customer acknowledges having read and accepts without reservation these general terms and conditions of sale.
ARTICLE 2 – PRICE:
The prices of our products are indicated on the site in euros including all taxes, excluding participation in processing and shipping costs. MM&Partners reserves the right to modify its prices at any time. When an order is placed, the products will be invoiced on the basis of the rates in effect at the time the order is validated. The products remain the property of MM&Partners until full payment of the price.
ARTICLE 3 – PROCESSING AND SHIPPING COSTS:
The products are delivered to the delivery address indicated during the ordering process. Deliveries in France are made by suitable carrier.
ARTICLE 4 – PLACING ORDERS:
On the Internet: http://www.terresolive.com/ The contractual information is presented in French and English and is the subject of a confirmation repeating this contractual information at the latest at the time of your order validation.
ARTICLE 5 – VALIDATION OF ORDERS:
Validation by the Client
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Validation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale. For orders placed directly on our website or by telephone if you have left us an email address, you will receive an email confirming your order.
Unless proven otherwise, the data recorded by MM&Partners constitutes proof of all transactions between MM&Partners and its clients.
Validation by MM&Partners
Upon receipt of orders, MM&Partners ensures the consistency of the data communicated. As part of its policy to combat fraudulent payments, MM&Partners reserves the right to conduct any necessary investigation before validating an order. This may include, in particular, requesting proof of address or requesting the contact details of your bank branch. When such a procedure is launched, validation of the order is suspended. If the order is not validated within 14 days, the order will be cancelled and the amounts paid refunded. This period may be extended if exchanges of documents are in progress between the customer and MM&Partners.
ARTICLE 6 – AVAILABILITY:
Our product offers are valid as long as they are visible on the site, within the limit of available stocks. In the event of a product being unavailable after placing your order (stock error, product breakage), we will inform you by email or telephone. We will then offer you a refund for the missing product(s) by credit card no later than 14 working days from the customer's decision by bank transfer.
ARTICLE 7 – DELIVERY:
The products are delivered to the delivery address you indicated during the ordering process. Deliveries are made by a suitable carrier selected by MM&Partners.
For credit card payments, orders are shipped within 5 days of online validation.
ARTICLE 8 – DELIVERY TIMES:
The delivery times indicated here are valid under normal service conditions and for shipments made by our usual carriers.
If the processing of your order (in particular due to the weight of the packages) required a special routing solution, the delivery times would be specified to you when you placed your order. If these times were not to satisfy you, you would have the possibility of canceling your order. Similarly, in the event of a road hauliers' strike (more generally any social disruption), or climatic incidents, the delivery times could be extended. These times apply to deliveries in Metropolitan France , for working days, excluding postal routing problems and subject to product availability.
ARTICLE 9 – DELIVERY DEADLINES :
The deadlines indicated in Article 8 are the delivery times usually observed. We undertake to deliver orders to France: within 15 days maximum following receipt of payment.
ARTICLE 10 – PAYMENT:
Payment for your purchases is made in cash:

either on our site by credit card: Visa, MasterCard, Carte Bleue. Payments are secured by the Stripe solution in conjunction with our bank CIC.
No payment period is granted and orders are not sent until payment has been received and collected.
Discount codes are only applicable to the value of the products, which must reach at least the value of the voucher and cannot concern shipping costs. This offer cannot be combined. Discount codes are not retroactive and can no longer be applied once the order has been placed. Discount codes that benefit from free products are valid while stocks last. Discount codes are valid until their expiry date.
ARTICLE 11 – COMPLAINTS AND AFTER-SALES SERVICE:
In case of exercising the right of withdrawal within the aforementioned period, we ask you to contact: contact@terresolive.com or to contact us at the following number +33 (0) 6.65.45.95.47 . We will reimburse you for the product(s) concerned within a maximum of 14 days from the date of the return request. The shipping and return costs are the responsibility of the buyer. The method of return is at the customer's choice. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) Return address: Terres Olive – ZA les Paluds, chemin du hangard d'Emilien 13400 Eyguières. We cannot accept returns of products that have been opened or whose packaging has been damaged. No return or replacement of product will be accepted for any products after the expiry of the use-by date. If these products are nevertheless returned, they will not be subject to any refund in any form whatsoever.
Packages delivered late
In the event of non-compliance with delivery times, the customer has the option to terminate the contract and may request a refund of the products ordered as well as the shipping costs. MM&Partners will inform the customer as soon as possible of any delay in advance.
Return of package
In the event of a package return, the address provided by the customer was incorrect or the package has been put on hold. The carrier will return the package to us. We will notify you as soon as possible. A second shipment may be made subject to payment by the customer of a shipping fee of 20 euros. If the customer prefers to cancel their order, it will be refunded excluding shipping costs.
Lost / undelivered packages
In the event of loss of a package (the carrier misplaced the package during delivery and the customer was never delivered), MM&Partners undertakes to send a second package at its own expense if the package is not found.
Defective or damaged products
MM&Partners will carry out all necessary checks and, if necessary, will contact the customer to ask for any useful information or photos. Following this, MM&Partners may respond favorably or unfavorably to the customer's requests. If the response is favorable, we undertake to reimburse you or exchange the products that are apparently defective, damaged or damaged (re-shipment is the responsibility of MM&Partners).

Refunds of products in the cases referred to in Article 10 will be made as soon as possible and at the latest within 14 days following the date on which the right was exercised.
ARTICLE 13 – APPLICABLE LAW – DISPUTE:
This contract is subject to French law. The language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction.

You have the right to access and rectify all data concerning you in accordance with the law defined by the National Commission for Information Technology and Civil Liberties (CNIL).
